POTENTIAL OF CREATING INHERITENCE COURT IN MALAYSIA: A LITERATURE REVIEW

Jurisdiction conflict between the Shariah and Civil Courts which prolongs even after existence of Article 121 (1A) gives a negative impact to Court particularly in matters concerning inheritance property management administration Muslims. Implicitly, this situation can cause surge unclaimed properties occur disputes among heirs seizing properties. From onset, objective article is study examine gaps previous research works relation potential creating Inheritance Malaysia. Methodology literature review employed qualitative approach design based upon content analysis. Data gathering was made through document analysis method data carried out descriptively.
